To quote the Houston Area Women's Center:
"If it hurts, it's abuse."
Just because people abuse each other all the time, doesn't mean it isn't abuse!
As for people with impaired or disabling conditions affecting their ability to communicate consent, that is even MORE reason not to take advantage and abuse people. When abuse is done to elderly, physically disabled or children who can't consent it's clearly criminal. Why not have the same consideration for others who aren't fully able to communicate and defend their free choice and interests?
