I think in such cases the crossover to disorder occurs when the paraphilia escalates from fantasy to reality. The thing about sadomasochism is that it's consensual. Psychologists categorize it in the same way as other paraphilias, but perhaps that needs to change. On the surface, this article seeks to address that issue, but it contains some ambiguous wording that could conceivably serve as a legal loophole.

 I don't agree. "Disorder" is more of a political word than scientific. Who decides what is a disorder? If people can be satisfied in their kink, why call it a disorder. It's like calling Sociopathy a "disorder." I call it thinking outside the box. <shrug>
