sc has long been subject of polarisation over this topic. Years have passed and yet, we're all at each others' throat. I personally am indifferent to the issue itself but I care about preserving / restoring harmony in our community. That's why we should have an open discussion about child rape, what are the pros, the cons, and ultimately, should we legalise it?
let's look at the two sides here.
PROS
childrape has been illegal for a while now. The 20th century gave rise to a plethora of regulations, all aimed at preserving children. As of today, we notice not a decrease of child abuse, but an upward trend. Of course this is worrying, and that's why proponents of legalisation argue that the current system has failed. In fact, any elements aimed at justifying the alleged success in the 20th century are to be taken with a grain of salt, as reporting was rudimentary back then.
solution: in order to facilitate radical change, archaic and inefficient structures must be torn down first. the current system does nothing to prevent child rape from happening. in fact, it incentivises it by focusing merely on the "after the act" part. by legalising child rape we loosen the reigns, and give power back to the children. When have they ever been asked anything? Let THEM decide how they want to be protected. A child rape law organised by children, for children, is what this world needs. Help child emancipation by empowering the child, not by speaking for it.
CONS
childrape is a relatively recent terminology. Raping children in fact was institutionalised for centuries and normalised throughout societies all across the world. With the advent of humanist thought, the distinction of adults and children made it possible for their separate realities to be manifested in law. This in turn led to the understanding that a child cannot provide consent. That's why we took it upon us to protect them, like we protect animals, blacks, gays and transvestites.
solution: since we illegalised child rape, it may not have had the desired effect, but at least we sometimes imprison pedos after they raped children. that's gotta count for something, right?
