He could be sued, but only for the extent of the financial damages assuming she even has an actual case here. 

 

Fraud

So... he'd just be made to return what he's already been given? 

What's to stop him from just going back and getting that money from Med again the exact same way? Repeat lawsuits of the same nature would likely weigh against the credibility of her case. 

Also, for real, does anyone here expect Med to actually contact a lawyer, especially when her own family doesn't trust her judgement? She'd need to throw even more money away towards legal fees. If her case continues to advance she may lose family privileges that she already takes (more than) for granted. 

Also, come a court situation, she'd need to be able to explain the situation. Somehow... I don't have much hope for her ability to do that credibly. It's all downhill for Med if she pushes this envelope, at the very least for matters involving her family's wealth handouts and inheritance. 

It'd cost her more than the $2000 she threw away to principally settle this matter. 

Misappropriation of Likeness

The individual whose pictures or social media content are used may have a claim against the perpetrator for misappropriation of likeness. This tort requires showing that the perpetrator used a protected attribute of another individual in an exploitative manner without the consent of the person to whom the attribute belonged.

Now this clause gets interesting: Has Chapo given consent for others to imitate his likeness?

It's not going to reach a lawyer without meds family finding out and they'll sooner stop it and take as a loss and reason to restrict the amount she gets as well as have new requirements for her to meet in order to get more money. 

If I were Chapo I'd go ahead with that restraining order in order to make the case that the scam was infact her own fault as he's not tried to make (obvious) contact with her. If she still tries to sue him he could likely countersue for libel and emotional/mental damages due to her stalking.

Do you mean the other day when she was trying to remember the name of polysomy 23 (which is an extra 23rd chromosome) Then she realized the annomally she was actually thinking of was XO  (which is only 1 X chromosome.)
