i agree, being incapacitated would take away choice completely in my book. it's the same logic behind being knocked out during sex not equating to choice. but if you're conscious during the kidnapping, yes, its a choice.

And then what are you supposed to do, outrun bullets?

I don't know if this really qualifies as "easy", seeing as the kid would weigh you down and would likely be squirming in fear. On top of that you'd need to reach past an armed assailant to get the kid in the first place, and if you're shot that'll probably disturb the little one further.

well, i see you're all flustered with my word choice. the point is there's never a time where you're conscious and have no choice in the matter

It's a fairly typical response to yell for help when in danger.

On both sides there is the potential for panic or aggression. In that sense, danger doesn't have to conform to basic logic, but more to how prone one is to automatic behaviors.
