If it happened at night it’s almost in your best interest to tell your attorney “The alleged assault occurred during the day of ____” (daytime assault instead of a nighttime assault which is 1/6 of the prosecutions case down the drain). If it happened during “daytime” make that very clear to your attorney. If you’ve never been convicted of an assault charge before this make sure to make this clear and if you have been it’s in your best interest to tell your attorney you didn’t really (defined as “very thoroughly”) know the previous person you assaulted (this is could kinda technically be false but honestly nobody really knows anybody) unless it was a domestic assault conviction. Generally you want to allege that the other person assaulted you too if they intentionally touched you. Never admit your motive unless you think it will bring sympathy. If you get to make a statement in court show as much remorse and sorrow as possible. If possible try to put in a motion to make the court date sooner and it is in your best interest if you know the other persons work schedule to try to make as many court dates as possible on days of the week that are very inconvenient for the plaintiff. Try to plead down to disorderly conduct if possible, or simple assault if charged with assault and battery and you don’t believe they will have solid evidence of battery. I’ve been charged with variations of assault 11 times and my only assault convictions have been against police officers. Also call your attorney and say “I deny everything” and hang up.
